By visiting or using any part of the Platforms — including browsing content, creating an account, or purchasing products or services (collectively, the "Services") — you ("you", "user", or "your") acknowledge and agree to be bound by these Terms and our Privacy Policy.
If you choose not to accept these Terms, you will be unable to access or use the Platforms or place any orders.
These Terms of Use constitute a binding agreement between you and Hasaki, under which Hasaki grants you access to and use of the Platforms.

2. Account Registration
To access or use certain features of the Platforms, you may be required to create a Hasaki account. By creating an account, you agree to:

Use only one personal account, refrain from creating accounts on behalf of others, and not transfer or assign your account to any third party.
Hasaki reserves the right to suspend or terminate any account that it reasonably suspects to be involved in fraudulent activity, misuse, or any violation of these Terms.
3. Product Information & Pricing
Hasaki strives to ensure that all product information displayed on the Platforms — including descriptions, pricing, and availability — is accurate and up to date. However, we do not warrant that such information is always complete, error-free, or current. Prices and availability of products are subject to change. Promotional prices or special deal campaigns are offered for a limited time and may vary depending on the market or platform.
All prices are listed in U.S. dollars (USD) unless otherwise specified, and charges will be processed in U.S. dollars at the time your order is confirmed.
If an error in pricing or payment is discovered after you place an order, we will notify you as soon as possible and provide the option to either reconfirm your order at the correct price or cancel it. If we are unable to contact you, the order will be treated as canceled, and any payment already made will be fully refunded.
The Services may occasionally contain typographical errors, inaccuracies, or omissions, and some information may not be complete or current. Hasaki reserves the right to correct, update, or modify such information at any time, including after an order has been submitted.
Applicable sales taxes and shipping fees will be calculated and displayed at checkout.
4. Orders, Payment & Billing
When placing an order through the Platforms, you agree that:

All orders are subject to Hasaki's acceptance and product availability;

Payment must be made in full through one of the approved payment methods (currently Visa and Mastercard credit and debit cards; additional payment methods may be added in the future and will be displayed at checkout when available);

You authorize Hasaki (and our designated payment processors) to charge the total order amount, including applicable taxes and shipping fees; and

You represent that you are authorized to use the payment method you provide and that the billing information you provide is true and accurate.
For your security, transactions may be subject to additional verification by your card issuer, such as 3D Secure authentication (Visa Secure or Mastercard Identity Check). If verification fails or your card is declined, please verify your billing details with your bank or try a different card.
Payment-card transactions are processed by third-party processors that maintain Payment Card Industry Data Security Standard (PCI DSS) compliance. Hasaki does not store full payment-card numbers on its servers after the transaction is complete.
Hasaki reserves the right to cancel or refuse any order for reasons such as product unavailability, suspected fraud, or pricing inaccuracies. In such cases, we will notify you as soon as possible and issue a full refund for any payment already made, where applicable. 5. Shipping & Delivery
We deliver within the United States through verified logistics partners. Title and risk of loss for products pass to you upon delivery to the carrier (F.O.B. origin), except where a different rule is required by applicable state law.
Estimated delivery times are provided for reference only and, except as expressly provided in our delivery policies, are not guaranteed. 6. Return and Refund
We want you to love your Hasaki purchase. If you are not fully satisfied, you may request a return or exchange within thirty (30) days from the date of receipt, provided that the product:

Is unused, sealed, and in original packaging; and

Is accompanied by proof of purchase.

7. Promotion
Hasaki may, from time to time, offer promotional campaigns, discounts, sales, or other time-limited offers, including fixed pricing, coupons, or special codes (collectively, "Promotions").
7.1 Applicable Terms
1. All Promotions are governed by these Terms and any specific rules, terms, and conditions (the "Supplemental Promotion Terms") displayed in connection with the particular offer (e.g., at checkout, within the app, or through other communications).
2. Promotions are subject to availability and may vary by market, region, or platform.
3. In the event of a conflict between these Terms and the Supplemental Promotion Terms, the Supplemental Promotion Terms shall prevail with respect to that specific Promotion.
7.2 Eligibility and Restrictions
Unless otherwise stated in the Supplemental Promotion Terms:
1. Promotions are non-transferable and intended for personal, non-commercial use only.
2. Discounts and coupon codes must be entered during the checkout process to be valid.
3. Promotional discounts generally exclude sales taxes, shipping fees, and gift-wrapping charges (if applicable).
4. Promotions cannot be combined with any other offer or coupon code.
7.3 Reservation of Rights
Hasaki reserves the right, at its sole discretion, to:
1. Modify or Cancel: Change, suspend, or terminate any Promotion at any time, for any reason.
2. Limit Participation: Restrict eligibility, participation per customer or account, or limit quantities purchased using a Promotion.
3. Reject Abuse: Refuse or cancel any fraudulent, abusive, or unauthorized use of Promotions, including purchases suspected to be for resale or profit that violate the personal-use nature of our Services.
4. Pricing Compliance: Adjust, suspend, or invalidate promotional pricing if product prices or market conditions change due to system errors, technical malfunctions, or external updates, to ensure accuracy and legal compliance.
Hasaki has no obligation to honor expired, canceled, or otherwise invalid Promotions.
8. Intellectual Property Rights
Except for your own User Content, all materials available on the Hasaki Platforms — such as text, software, code, designs, graphics, photos, sounds, music, videos, applications, interactive features, articles, sketches, animations, stickers, artwork, and other materials (collectively, "Content") — are the exclusive intellectual property of Hasaki or its licensors, and are protected by copyright, trademark, patent, and other applicable laws.
You may access and use the Content only for your personal and non-commercial purposes, and only as expressly permitted under these Terms. All rights not expressly granted to you are reserved by Hasaki.
Our intellectual property includes, but is not limited to, the names, logos, product and service names, slogans, and overall visual identity of Hasaki and its sub-brands. These elements are protected as trademarks, service marks, trade dress, or trade names owned or licensed by Hasaki, and may not be copied, reproduced, imitated, or used — in whole or in part — without our prior written permission.
You do not obtain any license or ownership rights to any of Hasaki's or its sub-brands' trademarks or other intellectual property through your access to or use of the Services. Please refrain from altering, obscuring, or removing any ownership or proprietary notices that appear on our website or in materials downloaded or printed from it.
Unauthorized use of any Hasaki Content may violate copyright, trademark, or other applicable laws. To report alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), please contact us at support@hasaki.com with the subject line "DMCA Notice."
9. User-Generated Content
Users may post product reviews, ratings, comments, or other materials ("User Content") on the Platforms.
Representations and Warranties. By submitting User Content, you represent and warrant that:

Your User Content is accurate, lawful, and does not infringe the intellectual property, privacy, or other rights of any third party; and

Your User Content does not contain unlawful, misleading, defamatory, obscene, or otherwise inappropriate material, nor include spam, malware, or advertising for third-party products or services.
You are solely responsible for your User Content and any consequences of posting or publishing it.
FTC Endorsement Guides Compliance. If you receive any product, sample, payment, free gift, discount, or other consideration from Hasaki (or from a brand featured on the Platforms) in exchange for posting User Content, you must clearly and conspicuously disclose this material connection in compliance with the Federal Trade Commission's Endorsement Guides (16 CFR Part 255). Reviews and endorsements must be honest, based on actual experience, and reflect the views you genuinely hold.
License to Hasaki. By submitting User Content, you grant Hasaki, its subsidiaries, and affiliates a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, distribute, display, and create derivative works based on your User Content in connection with the operation, improvement, and promotion of Hasaki's Services, in any media formats and through any channels now known or later developed.
This license is for the limited purpose of enabling Hasaki to make your User Content available on its Platforms and promotional materials, and does not transfer ownership of your content. To the extent permitted by applicable law, you agree that Hasaki's use of your User Content may not always include attribution, and you waive any claims related to such use.
Moderation. Hasaki reserves the right, but not the obligation, to monitor, edit, remove, or moderate any User Content at its sole discretion if it violates these Terms or is otherwise deemed inappropriate. 11. Disclaimer Of Warranties
Hasaki provides all Services, including the Platforms and any content provided therein, "AS IS" and "AS AVAILABLE" without any representation or warranties of any kind, whether express, implied, or statutory.
Hasaki disclaims all warranties with respect to the foregoing, including the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not represent or warrant that the Services or any content provided therein are accurate, complete, reliable, current, or error-free, or that access to our Services will be uninterrupted.
We cannot and do not represent or warrant that our Services, our servers, or any content or materials provided therein will be free of viruses or other harmful components. Hasaki shall not be liable for any damage to your device or other property resulting from your access to or use of the Services.
You acknowledge that product results or effectiveness may vary between individuals. You expressly agree that your use of the Platforms and Services is at your sole risk and you assume full responsibility and the entire risk as to the quality and performance of the Services.
12. Limitation Of Liability
To the fullest extent permitted by applicable law, neither Hasaki nor any of its affiliates, employees, directors, agents, or representatives shall be liable to you under any theory of liability — whether in contract, tort, negligence, warranty, statute, or otherwise — for any indirect, incidental, special, exemplary, punitive, or consequential damages arising out of or relating to your use of, or inability to use, the Services.
Without limiting the foregoing, Hasaki shall not be liable for any loss of revenue, lost profits, lost data, loss of goodwill, business interruption, or any similar losses, even if Hasaki has been advised of the possibility of such damages.
To the extent permitted by law, Hasaki's total liability for any claim arising out of or relating to the Services shall be limited to the extent expressly required by applicable law.
Your sole and exclusive remedy for dissatisfaction with the Services or any related materials is to discontinue using the Services.
Nothing in these Terms shall exclude or limit liability for gross negligence, fraud, or intentional misconduct, or any liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend, and hold harmless Hasaki, its parent company, affiliates, officers, directors, employees, and agents (collectively, the "Hasaki Parties") from and against any and all claims, liabilities, losses, damages, and expenses (including, without limitation, reasonable attorneys' fees and costs) (collectively, "Damages") incurred by the Hasaki Parties arising out of or relating to:

These Terms, and any dispute, controversy, or claim arising out of or relating to these Terms, the Products, or the Services (each, a "Claim"), shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law rules or principles that might otherwise cause the laws of another jurisdiction to apply.
To the extent applicable, U.S. federal law shall also govern and preempt any conflicting state laws.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to these Terms or to any transaction or relationship between you and Hasaki.

19. Force Majeure
Hasaki shall not be liable to you for any delay or failure to perform its obligations, including but not limited to processing orders, providing Services, or fulfilling deliveries, when such delay or failure results from circumstances beyond the Company's reasonable control ("Force Majeure Events").

If an order cannot be fulfilled as a result of a Force Majeure Event, Hasaki's sole obligation shall be to refund any payment made by you for the undelivered portion of the order.
